Bit of advice my ute is going in for its 3000k service tommorow and after hearing some horror storys of people spare going missing or being replaced with a ****** one i took mine off/out but when i slid it out from under the car there is a huge chunk/gash in the tyre and a decent size kerb dent/chunk.
Whats your thoughts on whats my best avenue to go down in regards to this.

I saw a vehicle being loaded onto a car carrier yesterday that was a bit far over to one side. Same thing happened, except the tyre deflated.

I would just report it and ask for it to be replaced. You've done nothing wrong so you've got nothing to hide.
But I've never heard of spares being swapped whilst the car is being serviced.

Can you see if there are marks where the wheel nuts go, indicating that the wheel had been fitted previously?
Possibly something like WILDB mentioned could have happened, and they swapped the wheels over. |

So then you can explain the situation to them with that as evidence. There should also be very minimal wear on the tread if it was fitted only during build and delivery.

I would ask for it to be swapped and if they don't kick and scream till they do.

It was probably damaged pre delivery. When the car got to the dealership for delivery, the detailers probably seen it and swapped it over with your spare. Seeing that damage you may want to get the front of your car checked and a wheel alignment.

Unfortunately happens quite a bit. Front and rear bars also get slammed. 95% of people dont inspect their "New" car at the dealership before they drive away. However for your OP of things being swapped at service time, I suppose I could and probably has happened in the past but I would think its fairly unlikely.

Did you pay for a spare alloy? Or did they just gift it to you after they damaged it?
Usually they charge an extra $300 for a spare alloy and tyre!! Looks to me they have damaged it and put a new one on before delivery and given you the old one as a good will gesture, instead of the standard steel rim. Happens all the time, usually caused by Toll unloading them off the trucks!! My XR6 ute had the same thing, dealer put a brand new one on it but weren't nice enough to give me the slightly scraped one back :( I would be asking the question though.... watch them run and duck for cover, your within your rights to ask for a brand new wheel and tyre, they should have given you the option of the damage one or a new steel spare at delivery.

That tyre is dangerous. There is nothing 'goodwill' about supplying the car with damaged wheels and tyres (it would be illegal to drive it at all- the spare tyre must be legal) and I would take it to an independent shop for a full S&S inspection.

There are plenty of actions you can take before you even spend a cent in this type of situation, the reason this kind of thing continues to happen is because people fail to take action when they are in the right. A replacement wheel and tyre is worth a lot less to a car dealer than the threat of serious legal action as well as reprimand from higher up within Ford. A simple call to fair trading will let you know exactly what action can/should be taken. |

It's not a murder trail, it's a low value civil action which simply rests on the balance of probabilities on who is telling the truth? |

All civil cases are proven on the balance of probabilities, but you still need evidence. The court isn't simply going to take your word for it if you have no evidence. Also, litigation is expensive. People can end up losing more than they gain. It is meant to be a process of last resort. Sometimes, even if people are in fact in their right ... it's just not worth it. Write off the loss and move on.

What way round does the spare sit under the rear tray.... ?
My guess is that the dealer may say it was damaged by a rock or something ? (Although it sure looks like a kerb hit)

So no chance of damage under the tray on that side.
