Default Denied warranty on FGX XR8

Did anyone see this? I wouldn't have thought warranty would be denied for going down the quarter mile.

We're assuming here the car was tuned, lets assume it wasn't I still think they should be covered under warranty assuming the car is 100% factory.

Isn't this supposed to be a "sports" car?

It's a performance car ffs. A supercharged V8 should be able to run down a drag strip issue free, why do they think people buy these.

Because its not considered a Motorsport event.
Its a drive day experience. Driver safety learning and instructions etc...
Mind you, if you bend the car, you may still have issues with your insurer regardless.

Either way, its only a performance car.... til it breaks....then Fraud roll their eyes and treat it like any other standard car. You can't win. Performance price tag and performance marketing with low to nil performance back up.
Same for most marques I guess.

From what I can gather, Ford have come up with the assumption that they took it down to the drags because of a spike in the ECU log.

If ford cant prove they took it to a drag strip can they still void warranty? Even if they did you would think they would back their product a bit better than that

Why buy a performance car if you cant use the performance?

Drag strip or a back street - shouldn't matter.

The car and engine are detuned to handle lesser conditions so that they can provide a warranty.

If everything is stock then pay up Ford.

Buying a car is a contractual arrangement with statutory warranties deemed to also apply..

Ford owes statutory warranties to provide a merchantable quality product fit for purpose. This statutory warranty on balance will likely be read fit for purpose to use on the roadway, not fit for purpose to use on a racetrack/dragstrip.

Ford in addition to the statutory warranty provides a contractual warranty, warrantying the car for 3 years, subject to the terms and conditions of that contractual warranty. I assume that the contractual warranty will exclude warranty in event car was used motor racing, and depending on definitions in the contract most likely will exclude drag strip and circuit racing etc.

Likewise any tune will negate Fords statutory warranty, because the car that failed was not the merchantable quality fit for purpose product Ford provided, that product no longer exists, it has morphed into a different product by the modifications.

Likewise the contractual warranty will exclude liability for performance modifications- need to look at terms and conditions.

This is not rocket science and Ford as a business also needs to operate as a commercial enterprise that is viable.

So-if the owner got a tune or was drag racing- you play you pay...

Me- I am going to get an intercooler and "conservative" tune when the car checks out and when I get used to its performance envelope, and if there is a mechanical failure which arises from the extra power from tune I have made the decision to self warrant....

Of course the car can hack it, but if it's been tuned then it's all over. Ford spend millions on tuning and someone thinks a tune shop offer greater reliability?

In this day and age (with speeding being worse than murder), it clearly doesn't make sense, lol

Never did my FPV drive day as my insurance company stated I would not be covered - period. I sent them all the info about the day and was a no go. It went right up to one of the insurance companies head honchos and was denied......bit of a bummer.

In saying that i used to own a VW GTi. It had dump pipe, cat, FMIC tuned to 22psi and intake

Took it in under warranty to tighten up turbo bolts as they were known to come loose. Service manager was wide eyed at all the mods but took it in and did the work. They took it for a good spin and all were happy. Top service.

Ford can tell that it had been tuned even when its back to stock tune.

When its been tuned, bye bye factory warranty. Even when the car has been sold on to another owner, the new owner then wears the consequences when something goes wrong, even if they are driving normally. Has happened before.
