Drink driving is bad enough. Unlicenced driving is bad. Drink driving whilst unlicenced is worse. Being a repeat offender of both resulting in a crash as damaging to others as this is unforgiveable as the offender has committed this crime before and to repeat it shows they have total disregard for the law. For just unlicenced driving repeat offences you would give them more fines/longer suspension as there could be a good reason as to why they did so. Unlicenced driving while drunk a second time is unforgiveable and should incur a mandatory prison sentence - no suspended sentences. If this guy keeps it up, revoke his refugee status and ship him home, this might encourage him to keep his nose clean.
It's previously been reported cultural differences, the view of the law in Sudan and language barriers are his excuses for these crimes. There's no excuse him not knowing the law as to get your L plates, there's usually a question regarding BAC restrictions. He's also been reminded of that law when in November 2004 he was done for drink driving and his probationary licence was suspended for 18 months. He was caught drink driving in December again blowing 0.272 and a warrant for his arrest issued. The latest incident was in May 2005 where he was driving unlicenced and drink driving - he blew 0.176 - yet he still gets off scott-free. If it's a fully licenced driver blowing 0.05-0.1, then you might show some leniency. But when the BAC is so much higher than the normal 0.05 for full licence drivers, and this guy wasn't allowed to have any in his system whilst driving, then there should be no leniency.

Magistrates are simply out of touch with societies values.
Last year in Goulburn court a guy was sentenced to 6 mths gaol for driving along the Hume at 232km/h in his Bentley. He was not driving whilst disqualified, he was not DUI, he did not injure anyone, he did not crash. :ticking: |

I couldn't believe what he got....I have no sympathy for drink drivers because of the pre meditated nature of the offence and the wide spread knowledge of what drink does to your ability to drive.
He should have been jailed - anything less is unjust What would he have got if he had a passenger in the car, lost it into a telephone pole and injured the passenger in the car who was now disabled? What would he have got if he lost it and hit another car....and a passenger in the other car had been disabled? Answer in both cases is he would have got a hell of a lot more than the ИИИИy slap he got in this case. If we are 5 k over the speedlimit in Vic we are branded dangerous killers and get fined $115 bucks.....he is drunk, has an accident and disables an innocent kid - lock him up. |

Yeah it's poor. i think the judge that lets him go and do it again should be made to pay for anything this guy does in the future. You'd see some changes then!
It shouldn't be that if you speed (even 5k over) you're given a worse penalty than drink driving AND hurting a bunch of kids! I think the judges are too worried about those wigs etc than they are about doing their job. Anarchy isn't that far off if this keeps up. Victoria might be better off with no laws. |

Just like the Bali 9 thread, I think the best punishment would be for a car to drive into him with a drunk driver behind the wheel, and then cut off his foot. He gets to feel the same pain as he administered then, and maybe hell think twice about doing it next time, or wont as he wont be able to drive like the poor kid, because he has no foot.
