Did we find out if the Finance company had a court order when they took the car?
Do they have such a court order? Did you sign anything at the time saying the could take it? Did they give you a receipt for the car? Have you ascertained how much is owed on the car? If its a "no" to all or most of these questions the Finance company may have taken the car under false pretences and you should take the matter up with you consumer affairs agency (OCBA) here http://www.ocba.sa.gov.au/ It sounds like you have ample witnesses of the repossession event. The finnace company will doubtless get a court order if you follow this line but getting the car back or having them threatened with such action could put you in a position of negotiating a better outcome. Taking over the loan or leasing the car until the debt is recovered. Yes; OCBA will also give you a lecture about not doing a REVS check but they should also be able to help you secure what few rights you have and advise you on how best to deal with the matter. A phone call is cheap and can't hurt. OK Just read the entire thread.
You have some options. You have already missed out on the first one, but i'll state it so others who may find themselves in a similar situation can take the path. 1/ When they turn up to reposess tell them to bugger off and get a court order/tow truck. When they have gone decontent the car as quickly as possible. First take anything you have added to it (you will lose it otherwise and certainly won't get compensated for any mods or enhancements). Then remove the valuable bits that will put people off buying it, remember at this stage you are potentially removing somebody elses property so go carefully and ensure you have a good story, "I sold the seats on ebay and am waiting for my new race seats to turn up". 2/ Go to the auction and buy your car back for less than is owed, the finance company will sell it for anything, they just want some money back. Your aim should be to get it for as little as possible. It may help to ensure a few freinds turn up and ensure other potential bidders are put off (maybe have one tell anybody inspecting it that it was driven into the sea or something). 3/ Go to the guy who sold it to you and get him to make the payments (3) so the car is returned, retake possesion of the car and when the time comes follow step 1. 4/ Forget it, move on and get a new car. Learn the lesson (an expensive one but it could be much much worse). $7k may seem like a lot of money, but with a little extra work and less socialising you can nail it pretty quickly. By the way option 1/. works. I have seen a person retreive a $20k repossesed car for $5k, its also one method car theives rebirth a car (steal, strip, buy at auction and rebuild, instant profit). |

Same thing happened to one of my workmates. He bought a VT for around 10k, it was repossessed about a year later as the first owner still owed money on it. He got legal advice and his lawyer ended up negotiating with the finance company that had it repossessed to pay them 4k to get it back. It may have cost him a bit of money that wasn't his to pay but he got it back. Even if it cost him extra it was still better than losing the lot.

You are allowed to cry under the circumstances but when you have finished please call the Office of Consumer and Business Affairs and get some free expert advice. Don't repeat the 1st mistake of not calling their REVS line; call them now.

Seems the smuch I bought it from, had skipped on paying his loan out. I raced back home and to ease the strees on mum and dad, we let the goon take it. I need to know if any one on this forum or others had this happen before. I'm ringing my finace company to get there legal people on board and if anyone knows of a law firm that can help me , please post there info. cheers Now.
