Angry UNR8D looses licance

well last night was rather eventful, leaving bunnings at carindale (southbrissy) i was pulled up by some 'friendly' *note scarcasm when due "Qld police Hoon Squad" officers in a white SV6.

went over my car with a fine tooth comb, came back with nothing, as expected then proceded to ask for my licance i handed it over and he asked if i had one? im like wtf?? i said yes i just gave it too you, he said yes but its suspended. at this stage im like 'wtf are you playing at' running thru my head last time i checked i had an open licance with 10 points still on it, what it turns out is that QLD transport couldnt get their act together with fine i had from last year in cairns, i elected to have the matter delt with in court but according to the guy i spoke to this morning ' he has notification that i sent it, but no record of it arriving' HOW THE HELL is this possible???? because its past the 28 days well and truely i Cant appleal and there is NO such thing as a work licance and i cant even get 1 point 4 one year :jab: :SaiyanSmi

to make things worse it looks like ill loose my job as i need a licance and i have been driving without insurance since early this month!!!!!! because QLD transport are too dam lazy to send out notices to say i have had my licance suspended i had NO IDEA and was driveng even company vehicles!!! :

so : to you qld transport and : : to the HOON squad who thought they had the right to bad mouth my car as it was a 'HOONS' car and told me that writeing it off with no insurance would be good as it would be one less for them to chase. IM LIKE WTF!!!!!


ahh im over it, just going to be riding for the next 2 months, might give me time to feed some more HP into the fairlane.

Hrmm... well it seems that he's tried his best to do the right thing since, and the prediciment that he's in at the moment isnt really his fault.

Ring up QLD transport, and tell them whats happened, or even better go in and see them. They might be able to give you a repreive or soemthing.

If there is record of it being sent and that can be verified you may be able to seek a review of the decision. Ombudsmen and review processes are there to prevent the "system" from reaching this type of a result. If you have genuinely tried to do the right thing (which it appears you have) it is not right to then be treated as if you have not tried to do the right thing.

Look into speaking to a relevant ombudsman or the Administrative appeals tribunal. As to the cost I am not sure, but what is your job worth to you.

I certainly wouldn't take it lying down.

Thats shit news dude.

My g/f got done with a similar problem where she had a fine dealt with by the infringement processing bureau but the bastards didn't process it properly and she got done for driving unlicenced.

She'd paid everything up, had receipts and a refund of money coz she overpaid it, yet they still reckoned it was her fault. Why the hell then if she owed them money did they send a refund ???

They're just hopeless....

definatley get it checked mate, doesnt the insurance company check to make sure you have a licence when you make a claim.....?

im almost 100% sure they do.......
in that case, if you had no licence when you had the accident a few weeks ago, they surely wouldnt have repaired your car.........

my thoughts exactly. anyways ive written a letter to the QLD department of transport in Fortitude Vally head office where its going to be reviewed i have gone to see them today and was told to put it in writeing and attach any relivant documents, i have done so and letter will be in their hands 'REGISTERED mail' by monday/tuesday next week, im sending it this was so they GET the dam thing and no more BS excuses.

ill keep this thread posted with how i go.

btw thanks Captain obvious mike, i got done for doing a u turn at 6:05 according to the coppa and it was legal to do a U turn before 6, i still belive it was 6 as thats what my clock said so its very debateable, i dont even mind paying the $60 but the 2 points for that was just down right rude. to add to that all my previous infringements over the years were <10 but >15kmh x3 over 3 years and drive vehicle to cause undue noise when i was young and stupid back in 00', so my driving history considering i was and still am on the road driving (sales) is pritty dam good, and thats including 2 full qld trips/thrus night cruzing/sat night cruzing. so id say im fairly well behaved, everyone stuffs up just some more than others.

damn that sux!

I remember when I got caught on a suspended license. All they did was, suspend it again for another month and fine me again. I didn't even go to the court hearing.

Best of luck getting it all sorted. How long will you actualy lose it for ?

3 months but it was suspended at the start of this month apparantly so only really 2 more months to serve. on the brigher side of things.

sorry to hear your dilema mate that sucks . but sometimes taking a bit of shit and copping the consequences avoids all this drama . i think you should of persued the court matter once you'd made that clear .they have pulled a swifty on you . it sucks in a big way , and these things are expected these days . sometimes it's easier to cut your losses pay the fine and all this wouldn't have happenned. it could've went 5 minites either way . in any case that was a close call.

In Qld, it's usually speed camera, or red light camera fines that have been sent to the wrong address. My missus suddenly found her licence was suspended, because of a fine they sent to an address we lived at 7 years ago.

A lot of people have whined and bitched to the polititians, but the end result is still the same... pay the fine or else!

yea i have heard a few similar stories, i really wish they would get their shit sorted and not put people in these positions, im looking at loosing my job atm because of this shit.

From a claims perspective on this point.
When a claim is lodged you speak with a telephone claims officer.
In the company I work for its called a "claims assist opperator"
They have 2 piles for thier paperwork basically, one pile is called
"claims for payment", the other is called "claims for consideration"
claims for payment are the strightfoward type claims were it is easily definable with minimal fuss. The claims for consderation pile is the pile that go and get investigated a lot further when all thise types of things like licences might be checked. by the way those claims are also handled by a different department called "claims specialists and technical unit"

However, in the instance that was described here by our distrought member (ford forums member) He has clearly been unaware he was under suspension.
Therefore even so from an insurance point of view (not legal as far as traffic law and cops being able to book you for it) there was no intent to drive unlicenced. You see any claim descion that is made MUST be able to stand up in court. Let me give two example here of what I mean and take the above as a 3rd example.

1st example.
Someone has been convicted of drink driving and has been to court and lost thier licence for 6 months. Next week he has been driving his car and has an accident then lodges a claim. Clearly he knows without a shaddow of doubt he was unlicenced and not allowed to drive.......claim denied!!!!

2nd example
Someone changes address and fails to notify qld transport/rac/etc....
when the licence renewal comes out it goes to the old address hence you never get the mail. Lets for the argument say you paid to get a 5 year licence last time you renewed it and your licence expires on 28.02.2005.
You have never bothered to look at your licence again as you expect the renewal will come approx 1 month before its due to remind you.
Here we are now on 29.05.2005 you have an accident and make a claim.
Even though you are unlicenced there was no clear intent to do so
therefore the claim would be considered further. I am not saying the descion will always go in your favor but if you see the difference in the examples you'll understand that it is not the be all and end all every time.

did reaserch, the accident happend a week before my suspention came into play, when the claim was lodged to when i got my car back was a total of 3 weeks by the time i had the car back i was then unlicanced:(, i really wish this was just a nighmare that would go away, i spend most of yesterday to and fro between courts/qld transport/and police departsments/ohh yea and sper. no one can just help with one matter its always someone elses problem and you can passed around like the local street hooker in the vally. it really annoys me, as Sper can tell you, ohh you have no suspentions dont know what your talking about then QLD transport say ohh talk to sper, you are suspended but they can only tell you why..... WTF!!!!!

Go and see a solicitor. It all depends on how much you want to spend on trying to get it back. The other thing is to fess up to work and see if they can figure a way to help you whilst you either sit it or sort it out.

yea well i just emailed them the letter and ive posted the origional, i hope to have a responce mid next week.

as for what they can do in the mean time, well qld transport told me nothing as they think within their power they have done everything responsibably and me loosing my licance is my problem and 'it dosent affect them if i loose my job, nothing can be done' was what i was told..... take it to court. : really freaking helpfull arent they.

well im pushying it to work now, and on top of that got to be an office bitch till i sort it out or ride it out :

That's not good news to hear, I hope you can get something sorted! Qld Police sound nearly as tight as their Victorian brethren. At least it's 'only' two months, not the whole twelve. Don't think I could handle public transport again, only had to venture on it once since I got my licence.
