Default non sticking tyers now i have to go to court

ok so about 7 or 8 months ago (27th march) i crashed my skyline in to a truck that was coming out of a drive way i think i was doing about 80 problem is there was 18 meters of skid marks and my car was totalled now i think it was because the tyres on the car where old and worn out because b4 i brought it the car was just sitting in the car never being driven so is that possible for tyres to get old like that if so how would i word it in court or am i screwed and have to lose my license for 12 months plus

Its not CSI, how do you know how long the skid was..........

And if it was CSI they would take the condition of your tyres into consideration, your brakes, they would look over you car for any mechanical issues.

Did they impound your car and investigate it?

If it was a fatal accident then yes maybe but not for a normal failed ot give way accident........

Your never going to learn from your mistake if you won't admit to it. Saying the tyres were old and worn out is a massive cop out. You stuffed up, crashed your car, all you can do is learn from it.

sounds to me like if your going to court, it was your fault anyway. you were doing 80kmh.....i bet that wasnt in an 80 zone either or the truck wouldnt have pulled out thinking he could make it.

I think your screwed.

Part of being a competent driver is maintaining your vehicle to certain standards. Doesn't matter if it had crappy tires when you 'brought' it. As soon as you started driving it you should have got them taken care of.

Surely a truck coming out of a driveway must give way to a vehicle on the roadway???? Smells a bit fishy to me.

I once came out of my driveway, after looking both ways and thinking I had plenty of room as usual on the main road. Then I almost got smashed in the side by a moron in a Magna speeding excessively in the 60 zone. Hmm, always double-check for unexpected things.

And he had the cockyness to beep his horn at me!

To answer the question - yes, tyres do harden as they age. It's not any sort of defense, however. Good luck, and I hope that whatever lesson is involved has been heeded - I rolled a car at 17, and have never had another accident because I took it as the reality check that it was.

i only had the car 3 weeks and i was broke from buying it and didnt have the money for tyres at the time oh well looks like 12 months for me then

LOL, that's a good one.

You're hoping 18m of skidmarks prove what, exactly? Stopping distance in ideal conditions without locking the brakes up is around 38m at 80kph.

Had a truck backed out into traffic in an 80 zone and given you insufficient time to evade or stop, I doubt you'd be up infront of the beak and about to lose your licence. So what are you leaving out of the story?

As long as it was a 70 or 80km zone you were in it should be the trucks fault , the truck failed to giveway to oncoming traffic end of story and you will be free , but if it was a 50 or 60km zone then I'd get a lawyer and they will find a loop hole if you have the cash spare.

Some critical info missing here.. firstly what were you charged with?

It would seem "cut and dry" by your "description" if the truck "suddenly" pulled out in front of you... why were you charged?

The magistrate will ask you for reasons why you should have your penalty lowered, saying that you need your licence to get to work will help, you may get several months taken off your suspesion/cancellation. I'm 10 months into a 12 month licence cancellation and over $1000 in fines etc for drink driving, It's horror and it sure teaches one not to be dumb again. :

This surprised me, have a look at these sites (and there are others). They are only guesstimates.

On a level concrete road 18m skidmarks seem to indicate a speed of around 60kmh.

As a disclaimer some of the commonly accepted braking distances (like those in The Bosch Book) look way too long. They claim 320m to stop from 200kmh (excluding driver reaction time). The stopping distances for some of the sporty cars quoted in the German rag Auto Motor & Sport easily beat this. I can easily knock off 100kmh when braking at or after the 100m mark from close to 200kmh when I am on a race track in my road car with R-spec tyres.

Yeah, but he didn't skid for 18meters then stop.
He skidded for 18 meters then crashed into something. If the truck hadn't been there he could have left marks for 50 meters (to throw a random number in).
Not really accurate to assume the speed based on how far the car skidded for (in this case).

If you're looking at 12 months a lawyer should already have been consulted. The courts are one big circus but if you don't play by the protocols [rules] you'll get jumped on. Don't even think of defending yourself as you don't lie very well, hire a professional. Even having a public defender will at least show that you're playing the game by their rules and give the beak some leeway in dealing with your case. Don't think you or this forum are smarter than the legal profession, you may well be, but they have the say and the contacts in the courtroom, on the day.

Sorry but in that case you can't afford to drive that car then. No excuses, so cop it on the chin.

If one thing I have learnt driving, it is never to do a dodgy on tyres! Replace them as soon as you know they are stuffed.

I had all 4 wheels spinning in the wet today. They are gone ASAP even though they are still road legal! Replace before it becomes a problem.

look i think i haven't learnt i just got off a suspension for speeding when i first week i got the car i havent done any thing stupid since that why i now have a falcon instead of a jap sports car that crash had cost me over 7g so far and after seeing my family and friend and my mum in tears i have learnt my lesson im not after sympathy i deserved to be punished i got so lucky i hit a soild truck and not a car the only reason i am asking is that im a welder by trade and since i cant get to work by public transport so early i cant do my job and im having trouble finding other jobs in the same field

Reread my post, I am not being critical, wasting your time or offering sympathy, what's done is done. The reasons you give in answer to Mitchay and others is more than enough justification to get a lawyer specialising in traffic offences to appear for you. The cost of a lawyer, even with barrister, should be small potatoes compared to the "7g" its already cost you. Without one you could easily find yourself in a lot more debt. You won't be the first person to lose a traffic case only to find that conviction held against them in a civil case for more costs/damages etc. Nothing, especially whether the skid marks are a major factor one way or the other can be decided here. You haven't mentioned having a lawyer so far, so I'm assuming that's so. If you do have one who's not doing enough, get another opinion. ASAP
