police checking cars?

hi guys,

i got off the train after school today, and noticed a police car driving slowly in the carpark. after i got a bit closer, i noticed that they were stopping near any car with a p-plate and checking it out. it didnt look like they were writing anything down, but they were checking the interiors a fair bit. i know they were checking my car out for a while.

can police give out a canary to a parked car? or do they have to catch you while driving?

will hate the day they check over my car..airhorns (illegal)..Gauges on pillar in chromes cups (they will say the affect visibility)..neons.. the list can go on..
soon i wont even be allowed a sports exhaust (which it has)

actually airhorns ARENT illegal on the provision that:
a) they are only of one note/tone
b) they arent connected to your main horn. (eg: use another button for them).

what state are you from?
i think the cops are able to issue a defect notice if they see something which they reasonably believe could be a defect, but im not entirely sure on that one

i'm in victoria.

the area i catch the train from is known for alot of hoons. (a few mins from hoppers crossing), and i've seen cops waiting for people to defect them. my car isnt exactly what you'd call roadworthy. i got it lowered last week, and before it was done, we measured to check its height, and it was already too low from factory. got me thinkin thats all

if its not on public roads they have no reason to think you might be driving it like that on there roads and therefore cant issue a work order

i think you can have neons, just cant be any of the 3 emergency colours (red blue or orange). sports exhaust is only for the new P1 and P2, which does not affect anyone who already has their p's.

tankclare: guages on the pillar, not 100% sure on this, but when i got pulled over in my EL, the cop said coz i only had 2 2" gauges, they were ok. anything bigger wouldnt be allowed. depends who pulls you over i guess.

You have got to be kidding, an EL thats too low from factory?
4WD springs were standard i thought...

They can issue a Defect without you being in or near the car, we were with mates and watched them defect a falcon for being too low, they basically tested the car, and then left the canary on the outside of the window.

Very true.

If you car is intended for street use it can be defected.

I can see where you are coming from, I would assume they were doing a random defect. Which really annoys me.
However, they could have received a report of a car that was stolen and dumped ot a car that was broken into. They could have been looking for that?

I don't think they were looking for cars to defect. Not sure why they would only be looking at P plate drivers cars, but I do know that they do often drive through train station car parks and check out the cars there to make sure that they have been left locked and that nothing valuable has been left in clear sight. I park at a train station every day and one day when I got back to my car there was a Police note left on my dash that said during random safety inspections my car was found with at least one door unlocked. The note had a check list on it that they tick off, on the list was things like "All doors locked", "Valuables left in clear sight", "Number plates securely fastened" and a few other things that I can't remember. There was about 5 or 6 things on the list.

lol thats true, but i dont own an EL anymore.

and yeah, there are some real tight asses around my area, so i do get paranoid when i see a cop car driving slowly scoping things out.

Exactly.. i think you'll find they're on the look out for car thieves, and will issue a "note" to alert motorists that they have left their car unlocked, or have valuable items in view of said thieves that might draw the wrong attention, just sounds like good community policing to me.

The only reason you would worry is if your car has defect issues, which the police are perfectly entitled to pick you up on.

Defect notices can be issued to a vehicle parked on a roadway or road related area even if the owner/driver etc is not present.

For definitions of roadway/road related area refer to Road Safety Act Victoria 1986.

If the driveway is on private property, the answer is no. But they can place a demand for the vehicle to be presented to a police station for inspection and if they observed the vehicle driving they can issue an infringement notice if the vehicle has any obvious defects.

Agree 100%, alerting to and preventing car theft is good policing.

i got a canary one night without being at my car story goes I ran into the pub were my girlfriend was working at left the keys in it and the window down (live in a small country town) was in there for about 5 mins no longer walked out and found 2 TOG cops writeing out a defect notice and to top it off i also got a fine for leaving my keys in the car sucks hey! cops go over board a hell of a lot witch is wrong if you ask me

Thats what happened to a friend of mine.. The officer defecting his car while it was parked in his driveway and in his property...
Me thinks he should have taken it further in that case... Oh well!

I think it will depend on the cops. I got pulled over for an rbt in WA a few weeks back and got a yellow sticker on my stock NC Fairlane for the horn fuse being blown, the plastic clip on the driver seat belt being broken and the tires being close enough (which he establish while he had his head inside the car). This was at 11am on a sunday morning after I hadnt had a drink but had a full rego, drivers licence, and outstanding warrant check. I havent had a demerit point the entire time I have had my licence, so after I passed all the checks he decided to give me a work order. Just depends how muchof an a%$ the cop wants to be. When I tried to explain that my car was perfectly roadworthy the cop explain that the could give almost any car a work order should they be inclined.

If the car is registered then it should be roadworthy. What does it matter where it is parked. yes private property and all that crap. just have your car legal or as close to legal as possible and do not attract the police. Police do checks of train stations all the time. Again if you got nothing to hide why would you be concerned about it. You guys are the drivers that slow down to 40 when you see a police car in a 80 zone. you have something to hide and feel guilty.

Its funny reading some of the contrasting opinions, personally when i see police driving slowly through a car park i feel suddenly more happy and comfortable in the knowlege that my car is safer as a result, yet some get all paranoid and guilt ridden, and cast negative aspersions against the police and their motives....

The bottom line is simply this, if your car is roadworthy, (or close too it) and you're doing nothing wrong you've got NOTHING to worry about.
