Default Hit someone up the **** and got a fine

Not me. But a guy at work was taking of from a green light, lost concentration for a second and hit the car in front. The driver he hit was complaining about chest pains so he called an ambulance for her. Ambulance turns up with the cops not far behind. Cops fine him $365 for staying to close to the car in front. WTF.

Sounds normal. If you hit anyone from behind it's considered your fault as that's the direction you're supposed to be looking.

You hit someone up the clapper your in the wrong. Lucky police didnt do more. I know Ive been in that situation.

Trust the snorters to find a quick opportunity to raise some revenue. It's a lottery with these c#$ntstables, the book gives them too much freedom to imply their own will.

Not quite sure what your problem is but if it was in NSW he got off light.

They could have hit him with Neg driving... $448 and 3 points.

Whoa there mate - no need for that.

By your own admission your mate "lost concentration for a second", so surely he would realise the buck stops with him.

The attending police actually gave him the easy option by issuing him with a ticket. They could have sent him off to court to face a charge of careless driving which would have resulted in a loss of licence and probably a larger fine.

What if the person in front brakes unnecessarily , for example giving way to a pedestrian who hasn’t yet crossed the road and when the pedestrian signal is red ? Who is wrong then ?

Does not matter, it is still the person at the rear who is at fault, it is very clearly defined that they are solely responsible for keeping a safe distance by law.

And it's for these exact reasons that you mentioned that the law is there, because accident's do happen, so if the person was traveling at a safe distance and concentrating then they should have enough time to avoid any contact.

I rear ended a guy a long time ago and wasn't charged.
He was.
He was coming the other way and for some reason decided to do a u-turn right in front of me.
My F truck took a little longer to stop in this situation and his 323 Mazda was very short in the end.

Makes sense, it would be deemed a failure to give way on his behalf as technically you weren't following him.

To the OP, personally i believe there is a difference between an accident and an incident, if you were driving down the road and a kid ran out in front of you and you swerved to avoid it and hit a pole etc. its an accident as it isnt really preventable by the driver, if you hit someone because you weren't paying attention it wasn't accidental as it could have been avoided with attention to the safe operation of a motor vehicle which is on the driver to maintain at all times, that is an incident.

Having a guess here.....


ford12 is annoyed to see a fine issued when the accident and damage could have been sorted between the 2 drivers and their insurances.


The inattentive lady that ran into the back of our wagon at a red light never saw a fine or a cop.
She did see her insurance sort out our damage and would have been asked to pay the excess fee.

As someone who is suffering ongoing pain that stops me getting a good night's sleep I'd really like to see the penalty for this type of accident considerably increased. My ongoing pain is as a result of a 2014 neck injury from when a lady using a mobile while driving ran into the back of another car queued at a red light pushing into the vehicle stopped behind me into the back of my ute. Her Mercedes didn't even slow down let alone brake, In nearly 50 years of driving I have never run into the back of another car or, so far (touch wood) had any accident deemed my fault (though I admit I had some very close call when I was younger that would have been my fault if there had been a collision). Yes accidents can happen, but there is no excuse for travelling too close to the vehicle in front or using a mobile phone or something similar while driving. It not only often how people end up with injuries like mine, but sometimes is how some people get much more serious injuries or get killed.

In QLD police won’t attend an accident unless people are injured or just happen to be there at the time.
This whole stigma of being 100% at fault for hitting someone in the rear is wrong. As already pointed out there are ways around it if you can prove the situation. Dash cam is your best friend in these situations.

Yep, I understood that and agree that is where the difference is.


So, yes the guy a PITA for not concentrating and driving into the rear of another car, but the guy did the right thing by getting help for the other driver and copped a fine for his troubles.
Or maybe the police were close by anyway ??

If he does this all again, be sure he'll reassess whether he should make that 000 call

Yep, and thats the problem with society these days, no one wants to own their mistakes, rather let the poor woman they just hit from behind possibly die on the side of the road from a heart attack from what should be a very survivable incident rather than cop the appropriate fine for causing it in the first place.

And “if” he or anyone else doesn’t make the call I hope their done for neg driving causing injury.
